CONDICIONES GENERALES

1. UTILIZACIÓN DEL VEHÍCULO

Queda expresamente prohibido, so pena de perder todos los derechos:

1.1. Conducir el vehículo personas no autorizadas expresamente por Costa Golf Car Hire, constando los datos en el anverso.

1.2. Destinar el vehículo al transporte de mercancías.

1.3. Utilizar el vehículo para remolcar o empujar a otros vehículos.

1.4. Participar con el vehículo en carreras, concursos o desafíos.

1.5. Conducir el vehículo bajo los efectos del alcohol o drogas.

1.6. Viajar mayor número de personas de las que permite la ley para el tipo de coche alquilado, o el transporte en servicio público de personas.

2. DEVOLUCIÓN DEL VEHÍCULO

2.1. El arrendatario devolverá el vehículo alquilado en el lugar y la fecha estipulados en el anverso y se compromete a mantener el vehículo, su equipo y sus herramientas en perfecto estado de funcionamiento. Cualquier alteración debe ser previamente autorizada por Costa Golf Car Hire. El incumplimiento de esta condición faculta a Costa Golf Car Hire a requerir judicialmente la devolución del vehículo.

2.2. Costa Golf Car Hire está plenamente autorizado para retirar el vehículo del arrendatario en cualquier momento, siempre que existan sospechas de que está siendo dedicado a actividades ilegales, o bien haya duda sobre la solvencia comercial del mismo.

3. CARGOS DEL ALQUILER

El arrendatario se compromete a pagar a Costa Golf Car Hire:

3.1. Los cargos por el alquiler del vehículo, depósitos, entrega y recogida, seguros, combustibles e impuestos determinados en la tarifa vigente.

3.2. El importe de la reparación de los daños causados al vehículo, en caso de accidente, cuando concurran las circunstancias descritas en el apartado 1 y 4 de estas condiciones generales o cuando quede demostrado que los daños o la avería han sido debidos a la impericia manifiesta, o el mal trato dado al vehículo por el arrendatario y/o conductores autorizados en el contrato.

3.3. Las multas de tráfico, así como los gastos por infracciones a la legislación vigente del Código de circulación.

3.4. El coste de la falta de alguna herramienta, neumáticos u otros accesorios del vehículo alquilado.

3.5. Los días de paralización del vehículo por accidente, avería o retención del mismo por Organismos Públicos, debido a la negligencia del arrendatario a razón de la tarifa del tipo de vehículo alquilado.

4. SEGURO, RESPONSABILIDAD Y ACCIDENTES

4.1. Costa Golf Car Hire no podrá responder de las sanciones, multas, pleitos incurridos por el arrendatario y/o conductores autorizados, así como los gastos judiciales que se deriven. Costa Golf Car Hire queda exento de la responsabilidad que surja en el accidente, incluso en el caso de que se deba a rotura de piezas mecánicas.

4.2. Únicamente los conductores aceptados expresamente por Costa Golf Car Hire tienen calidad de asegurados y están cubiertos con un seguro obligatorio.

4.3. La responsabilidad civil del arrendatario con respecto a los daños causados al vehículo arrendado está cubierta totalmente en los casos de incendio y robo, y limitado en caso de accidente a una franquicia según la tarifa en vigor. El arrendatario queda exento de esta responsabilidad mediante el pago de la prima correspondiente según tarifa. Los días de paralización del vehículo (apartado 3.5) no están cubiertos por el seguro y se facturarán aplicándose la tarifa vigente para el tipo de vehículo alquilado.

4.4. En caso de accidente, robo o incendio, incluso parcial, el arrendatario se obliga, so pena de perder los derechos del seguro, a:

4.4.1. Comunicarlo en plazo máximo de 24 horas desde que se produjo el mismo a Costa Golf Car Hire.

4.4.2. Obtener datos de la parte contraria y posibles testigos cumplimentándolo en un parte que remitirá a Costa Golf Car Hire dentro del plazo de 48 horas desde que se produjo el accidente, haciendo constar las circunstancias, lugar, fecha y hora del incidente.

4.4.3. Notificar inmediatamente a las autoridades, si la culpabilidad de la otra parte debe ser investigada, o si hay personas heridas.

4.4.4. No reconocer o prejuzgar la responsabilidad del hecho.

4.4.5. No abandonar el vehículo alquilado sin medidas necesarias para protegerse.

4.5. El seguro no cubre:

4.5.1. Accidentes debidos a la influencia del alcohol o drogas.

4.5.2. Conductores que no están en posesión del permiso de conducir.

4.5.3. Pinchazos, la rotura (total o parcial) o pérdida de llantas y daños a los neumáticos.

4.5.4. Los daños que sufre el vehículo como consecuencia de desniveles o mal estado de la calzada o daños ocasionados por la circulación por carreteras no asfaltadas.

4.5.5. Los daños ocasionados fuera del periodo de vigencia del contrato.

4.5.6. Los objetos transportados en el interior del vehículo. Costa Golf Car Hire declina toda responsabilidad por accidente o daños a propiedades ocasionadas por el vehículo de alquiler si deliberadamente el arrendatario ha suministrado a Costa Golf Car Hire información inexacta relativa a su identidad, domicilio o validez de su permiso de conducir.

4.5.7. Daños causados en los bajos del vehículo.

4.5.8. Pérdida o rotura de llaves y gastos que conlleva.

4.5.9. Error al repostar combustible y gastos que conlleva.

4.5.10. Daños ocasionados al embrague por su uso inadecuado.

5. JURISDICCIÓN

Para cualquier divergencia que surgiera entre el arrendatario y Costa Golf Car Hire en la interpretación de las normas y condiciones de alquiler descritas y cualquiera que sea la nacionalidad del arrendatario serán sometidas al fuero de los tribunales de Málaga y la legislación española con renuncia expresa a cualquier otra.

GENERALS CONDITIONS

1. USE OF THE CAR

It´s strictly prohibited resulting in loss of alt rights:

1.1. Persons driving the vehicle not authorized by Costa Golf Car Hire and not stated on the reverse.

1.2. Participation in races or contests of any kind.

1.3. To use the vehicle for the transportation of goods.

1.4. To use the vehicle to push or tow other vehicles.

1.5. Driving the vehicle under influence of alcohol and/or drugs.

1.6. Travelling in the vehicle more persons than the number specified by the Law for that particular vehicle.

2. RETURN OF THE VEHICLE

2.1. The client will return the vehicle in the place and on date stated on the reverse and undertake to keep the vehicle, its equipment and tools in perfect conditions. Any Kind of change should be previously authorized by Costa Golf Car Hire should this condition not be obeyed Costa Golf Car Hire can lawfully demand the return of the vehicle.

2.2. Costa Golf Car Hire is fully authorized to withdraw the vehicle from the client at any moment when there exists suspicion that the client is involved in illegal activities, that the vehicles is used in illegal activities or if there are doubts about his solvency.

3. CHARGES OF THE RENTAL

The client promises to pay to Costa Golf Car Hire:

3.1. The charge of the rental of the vehicle, delivery and collection, insurance petrol and taxes as indicated in the current rates.

3.2. The costs of repair or damage caused to the vehicle in case of accident when in accordance with the circumstances as described in articles 1 and 4 of these conditions and the charge of repair including towing charges or any additional expenses when it s shown that this is due to negligence or misuse of the vehicle by the client or authorized drivers.

3.3. Traffic fines, reports and official statements draw up against the client or the additional drivers.

3.4. The costs of missing tools, jack, tires and other accessories of the rented vehicle.

3.5. The number of days in which the car is immobilized due to accidents, mechanical failure or towed away or retained by the Authorities due to clients negligence, which the client will compensate in accordance with the current rates of the type of vehicle rented.

4. INSURANCE, RESPONSABILITY AND ACCIDENTS

4.1. Costa Golf Car Hire is not responsible for traffic fines, reports or official statements drawn up against the client or accidents even in case that these are due to mechanical failure.

4.2. Only drivers authorized by Costa Golf Car Hire are entitled to the status of being issued.

4.3. The Civil Responsibility of the client with respect to the damages caused to the vehicle in case of fire and theft is totally covered and partially in case of an accident with an insurance excess according to the current rates. This excess is waivered if client at the time of rental obtains the collision damage coverage. The number of days in which the car is immobilized (article 3.5) is not covered by the insurance and the client will compensate Costa Golf Car Hire in accordance with the current rates of the type of vehicle rented.

4.4. In case of accident the client is obligated to the following (under possible loss of insurance):

4.4.1. Contact Costa Golf Car Hire within 24 hrs from the time that the accident occurred.

4.4.2. Obtain and summit to Costa Golf Car Hire all of the data from the other party and possible witnesses within 48 hours after the accident occurred specifying details about the accident, the place, date and time.

4.4.3. Notify immediately the Authorities if the fault of the other party should be investigated or if there are persons injured.

4.4.4. Not to admit of prejudge with whom the blame lays.

4.4.5. Not to abandon the rented vehicle without previously taking the necessary measures to protect it.

4.5. The insurance excludes:

4.5.1. Accidents due to the influence of alcohol and/cr drugs.

4.5.2. Drivers without a valid driving license.

4.5.3. Punctures or other (total or partial) or loss damages to the rims and damages to the tires.

4.5.4. Damages when the vehicle is driven on untraced roads or roads in bad conditions, or damages due to accidents occurred on untracked roads.

4.5.5. Damages before or after the rental period started in the contract.

4.5.6. Clothing, luggage or other articles.

Costa Golf Car Hire decline all responsibility for injuries to third parties or damage to the vehicle if the client or the authorized drivers deliberately supplied Costa Golf Car Hire with false information as to his identity, address, driving license, etc.

4.5.7. Damages caused to the underneath of the vehicle.

4.5.8. Lost or broken keys and all the costs involved.

4.5.9. Error of fuel and all the costs involved.

4.5.10. Burnt clutch due to misuse.

5. JURISDICTION

In case of any kind of this agreement between the client and Costa Golf Car Hire in the interpretation of the norms and conditions of the rental agreement regardless of the nationality of the client, he will be subject to the Court of Malaga and Spanish Laws only and not any other country or jurisdiction.
